This Privacy Policy governs Your access to and use of Plainlylegal.com, all its subdomains, and the Plainly Legal™ Software-as-a-Service (the “Software”) and all of its subdomains (e.g., app.plainlylegal.com), including any content, functionality, and services offered on or through Plainlylegal.com and all of its subdomains (e.g., app.plainlylegal.com) (collectively, the “Website“), whether as a guest or a registered user.

When accessing the Website, the Company will learn certain information about You, both automatically and through voluntary actions You may take, during Your visit. This policy applies to information we collect on the Website and in email, text, or other electronic messages between You and the Website.

When You access the Website, the Company will learn certain information about You during Your visit.

Information You Provide To Us. The Website provides various places for users to provide information. We collect information that users provide by filling out forms on the Website, communicating with us via contact forms, responding to surveys, running queries on our search feature, providing comments or other feedback, and providing information when ordering a product or service via the Website.

We use the information You provide to communicate with You, deliver the requested product and/or service, improve our overall site performance, and provide You with offers, promotions, and information.

Information We Collect Through Automatic Data Collection Technology. As You navigate our Website, we use automatic data collection technologies such as cookies, pixels, server logs, and analytics software to collect certain information about Your equipment, browsing actions, and patterns. This will generally include information about Your location, traffic patterns through our website, and any communications between Your computer and our Website. Like other commercial websites, our website utilizes a standard technology called “cookies” and server logs to collect information about our site’s use. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent at our site, the websites visited just before and after our own, and Your IP address.

The Company uses various tracking pixels, including without limitations those provided by Google, Meta, TikTok, and HubSpot. These pixels track visitors to our websites to tailor advertising messages users see while visiting our site and other websites. The Company reserves the right to use these pixels in compliance with the policies of the various social media sites.​

Email Information & Polices

If You choose to correspond with us through email, we may retain the content of Your email messages, Your email address, and our responses. We provide the same protections for these electronic communications we employ to maintain information received online, by mail, and by telephone. This also applies when You register for our website, sign up through any of our forms using Your email address, or make a purchase on this site.

We are committed to keeping Your email address confidential. We do not sell, rent, or lease our subscription lists to third parties and will not disclose Your email address to any third parties except as allowed in the Disclosure of Your Information section.

We will maintain the information You send via email in accordance with applicable federal law.

In compliance with the CAN-SPAM Act, all emails sent from our organization will clearly state who the email is from and provide clear information on contacting the sender. In addition, all email messages will also contain concise information on removing Yourself from our mailing list so that You receive no further email communication from us.

Our emails allow users to opt out of receiving communications from our partners and us by following the unsubscribe instructions at the bottom of any email they receive from us at any time.

Users who no longer wish to receive our newsletter or promotional materials may opt out of receiving these communications by clicking on the unsubscribe link in the email.

The Company collects Your information to record and support Your participation in Your selected activities. We collect Your information if You register to download a book or resource, sign up for our newsletter, and/or purchase a product from us. We use this information to track Your preferences and to keep You informed about the products and services You have selected to receive and any related products and/or services. As a visitor to this Website, You can engage in most activities without providing any personal information.

If You opt to receive any free resources, participate in any free training programs, register for a webinar, register for a live event, register for a seminar, or purchase any products sold by the Company on this Website, we will automatically enroll ​you to receive our free email newsletter. You can unsubscribe anytime if You do not wish to receive this newsletter. We include an “unsubscribe” link at the bottom of every email. If You ever have trouble unsubscribing, You can email support@plainlylegal.com requesting to unsubscribe from future emails.

How We use The Information You Provide

We use the personal information you provide to us differently on our Website and within the Software.

On Our Website. We use personal information for purposes of presenting our Website and its contents to You, providing You with information, providing You with offers for products and services, providing You with information about Your subscriptions and products, carrying out any contract between You and the Company, administering our business activities, providing customer service, and making available other items and services to our customers and prospective customers.

From time to time, we may use the information You provide to make You offers to purchase products and services provided by third parties in exchange for a commission to be paid to us by such third parties. If You opt to participate in such promotions, the third parties will receive Your information. From time to time, we may use the information You provide to us to display advertisements to You that are tailored to Your personal characteristics, interests, and activities.

In Our Software. We use the personal information you provide to us and that our system automatically collects to deliver the services provided by the Software. Among other things, we use the information you provide to compile the legal documents and agreements you request and to provide guidance in the Software’s other core functionalities.

Retention of Data and Personal Information

We retain your data and personal information so long as reasonably necessary for its intended uses.

The personal information that you choose to provide by interacting with our website (e.g., your name and email address provided on an opt-in form) is maintained until either you ask us to delete it or we decide to delete that information from our marketing automation provider.

The personal information collected automatically by outside tracking pixels is stored consistent with the privacy policies and data retention policies of the companies that provide that data.

So long as you remain a subscriber of the Plainly Legal™ Software, our system will retain the data and personal information you provide within the Software until you choose to delete that information or the results created using that information (e.g., agreements generated by our system using your inputs). When a user deletes information, our system will retain it in an archived state for a period of six months so that it can be retrieved upon request of the user.

When users unsubscribe from the Plainly Legal™ Software, our system will archive all of their data for a period of six months after their subscription ends. If You resubscribe within those six months, You will be able to retrieve that data. After six months, we will permanently delete the data and it will not be retrievable.

If You are a subscriber who wishes your data to be deleted immediately without an archive period, you may request for your data to be deleted consistent with the process outlined in the Users’ Rights section below.

Disclosure of Your Information

As a general rule, we do not sell, rent, lease, or otherwise transfer any information collected from You. We may disclose Your personal information to our subsidiaries, affiliates, service providers, and technology partners to provide our services to You. The following

Our Technology Partners

To facilitate the operation of the Website and associated Software, we have partnered with the following technology providers.

HubSpot, Inc. We utilize HubSpot’s technology in various ways in our operations, including as our email service provider, marketing automation provider, knowledge base provider, support chat provider, and payment processor. To the extent you engage with our website or software application, we will store your contact details and other information within HubSpot.

Peaberry Software, Inc. dba Customer.io. We utilize Customer.io's technology as our email service provider, marketing automation provider, and in-app messaging functionality. To the extent you provide an email address and/or engage with our website or software application, we will store your contact details and other information within Customer.io.

Help Scout. We utilize Help Scout's technology to provide our knowledge base, support chat, and email support. To the extent you engage with our support functionality, we will store your contact details and other information within Help Scout.

Stripe, Inc. We utilize Stripe’s services directly and/or through HubSpot to provide payment processing services. To the extent that you complete a purchase on our website, information about that transaction will be shared with Stripe.

Igil Webs SRL dba FirstPromoter. We use FirstPromoter to operate our affiliate and referral programs. To the extent that You click a link of one of our affiliate or referral partners, that information will be shared with various of our technology partners, including FirstPromoter and HubSpot.

Clerk, Inc. We utilize Clerk’s technology to manage users’ access to the Plainly Legal™ software. If you subscribe to the software, Clerk’s software will manage your username and password. To facilitate this process, we will share email addresses of individuals who subscribe to our software to “whitelist” those emails within the Clerk system. Clerk currently stores all data in the United States.

PlanetScale Inc. We use PlanetScale to store data for the Plainly Legal™ software service. To the extent you subscribe to the software, the data you enter within the software will be stored on PlanetScale servers. This includes any raw data that is retained and the resulting audit results, legal documents, and chat logs. Our current arrangement with PlanetScale includes storing data in the United States.

Prisma Data, Inc. We currently use Prisma to access the data stored on PlanetScale, Inc., including the code and databases associated with the Plainly Legal™ software.

Cloudflare, Inc. We use Cloudflare’s system to store edge database iterations of the database information that is housed at PlanetScale. This storage system allows our system to run with lower latency, provide quicker response to users, operate at enhanced security levels. To the extent you subscribe to the software, the data you enter within the software will be stored in Cloudflare edge databases.

OpenAI, L.L.C. We will use OpenAI’s API to provide artificial intelligence services to provide various services inside of the Plainly Legal™ software. Specifically, we will use OpenAI’s services within the ChatLegal™ functionality to match questions with answers that are stored in our database and to convert the lawyer-drafted answers into conversational responses that include context from the user’s inputs. If you opt to use the ChatLegal™ feature, your inputs within that functionality will be shared with OpenAI via its API.

We will also use OpenAI’s functionality to convert complete legal agreements into easy-to-understand, plain English explanations. To the extent you choose to use that functionality, we will share the agreement you ask to be explained, including any personally identifiable information contained in that agreement, to OpenAI’s system.

Under its data usage rules, OpenAI will only retain the information we provide to it for 30 days and will not use that data for training.

Zapier Inc. We use Zapier to transfer data between our other technology partners (e.g., to add a user to the whitelist for our Software that is stored in Clierk, Inc. when a user makes a purchase). In the process, Zapier processes and stores user data on our behalf.

Information We Share With Affiliates

We operate various programs that allow existing users and others (individually, an “Affiliate”) to refer other individuals and businesses to our services (collectively the “Affiliate Program”). If you click on a link provided by an Affiliate, our system will recognize that you were referred by that Affiliate.

If you complete a form on our website or purchase a subscription after clicking on a link provided by an Affiliate, we will share your name, email address, and details of any purchases and renewals with that Affiliate.

We share your information with Affiliates so they can tailor messages to individuals they are promoting our services to and so they can deliver any bonuses they have promised to individuals as an incentive to subscribe to Plainly Legal™.

How We Protect Your Information and Secure Informaton Transmissions

We employ commercially reasonable methods to ensure the security of the information You provide and the information we collect automatically. This includes using standard security protocols and working only with reputable third-party vendors. Similarly, we have partnered with other technology vendors that employ security protocols to secure Your data.

Email is not recognized as a secure medium of communication. For this reason, we request that You do not send private information to us by email. However, doing so is allowed, but at Your own risk. Some of the information You enter on our website may be transmitted securely via a secure medium known as Secure Sockets Layer or SSL. Credit Card and other sensitive information is never transmitted via email.

The Company may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas.

For site security purposes and to ensure that this service remains available to all users, the Company uses software programs to monitor network traffic and identify unauthorized attempts to upload or change information or otherwise cause damage.

Policy Changes

Our policy is to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify You by email to the email address specified in Your account and/or through a notice on the Website home page. Users' Rights

Users of this site who are located in certain locations, including the European Union, are entitled to certain information from the Company and to make certain requests of the Company. Those rights include:

We require only the information that is reasonably required to enter into a contract with You. We will not require You to consent to any unnecessary processing as a condition of entering into a contract with us.

While we are only legally required to honor these requests for some users, it is our policy to honor these requests from all users, regardless of location.

"Do Not Track" Requests

Certain internet browsers allow users to send “Do Not Track” requests to sites they visit. Unfortunately, there is no industry or legal standard (or easy technological solution) to handle these responses. Thus, we don’t currently honor Do Not Track signals.
